A coerência deve orientar os atos de pensar, agir e julgar, permitindo a convivência social e do indivíduo consigo mesmo. Em sua obra, Karla Fernandez defende a observância da máxima da coerência quando do ato de julgar, demonstrando que este compulsa como tarefa árdua que demanda a análise de pré-compreensões e dos fatores fáticos e jurídicos envolvidos, sem desconsiderar o contexto que os circunda. Assim, insurge-se contra julgamentos que escolhem premissas e desenvolvem uma trilha argumentativa para apresentar uma resposta fundamentada; ao destacar que o julgador, quando compromissado com a coerência, pelo exercício da análise da parte pelo todo e do todo pela parte, termina por encontrar a resposta do caso, a qual por meio de tal padrão se revela. Desta feita, valendo-se das reflexões de filósofos como Immanuel Kant, Hannah Arendt e Ronald Dworkin, questiona, a partir da máxima da coerência, o método de sopesamento desenvolvido por Robert Alexy, que propõe fórmula, fincada em uma metódica das ciências exatas, para solução dos casos de colisão de princípios; ressaltando que o anseio de imprimir previsibilidade na seara do direito com a desconsideração do seu teor axiológico, composto por múltiplos filamentos interligados, termina por desnaturar o seu propósito de distribuição de justiça e pacificação social, culminando em um contexto de mais insegurança jurídica. 10
