Este trabalho tem como objetivo abordar alguns dos problemas mais atuais enfrentados pela proteção à posse simples na província de Tucumán. Será dada especial ênfase à proteção rural regida pelo art. 40 da lei provincial 4.815 de procedimento perante a Justiça de Paz Lega, e àquela regida pela lei 7365 de justiça de Paz letrada. Comparando-o com o amparo à posse simples de um imóvel urbano regulado pelo Código Processual Civil e Comercial de Tucumán, verificará-se, em particular, a relação com as normas do Código Civil e Comercial da Nação, acrescentando, para cada caso, o que a jurisprudência provincial expressa sobre a questão.
