A proposta deste obra é questionar a validade e utilidade prática dos registros de antecedentes criminais do indiciado ou acusado, a partir do arquivamento dos autos do inquérito policial ou peças de informações equivalentes, ou na hipótese de extinção do feito em sede jurisdicional, seja pela absolvição do acusado com trânsito em julgado, seja pelo desinteresse estatal na persecutio criminis. Em caso de absolvição própria, tanto pelo reconhecimento de alguma causa excludente da ilicitude, de culpabilidade ou inexistência de tipicidade, quanto pela insuficiência ou inexistência de prova de autoria e materialidade, ou até mesmo pela anulação total do processo. O texto contempla um breve estudo sobre Direito Constitucional, a partir da teoria dos direitos fundamentais, e direito subjetivo inominado relativo ao esquecimento, como forma de resguardo à intimidade e a dignidade humana do acusado. Dialoga com o Direito Penal e Direito Processual Penal, no que tange às preliminares atividades da persecutio criminis, e finaliza trazendo à baila o entendimento dos tribunais brasileiros sobre a temática principal do estudo. 10
